SELLER MAKES NO WARRANTY OF MERCHANTABILITY WITH RESPECT TO THE GOODS SOLD UNDER THIS SHIPPER/INVOICE. Buyer affirms that he has not relied on Seller’s skill or judgment to select or furnish good for any particular purpose, and this sale is made WITHOUT ANY WARRANTY BY THE SELLER THAT GOODS ARE SUITABLE FOR ANY PARTICULAR PURPOSE.
Adequate samples for customer testing will be furnished free of charge, upon request. Buyer affirms that he has had ample opportunity to inspect and examine the same as fully as he desires, and that he has examined the samples and found them suitable for his particular use. No warranty is made by the Seller, except that the goods to be delivered and sold under this Agreement will be substantially identical with the samples tested and/or inspected.
The warranty liability of Edgar A. Weber & Company is expressly limited to replacement of all flavoring material which may be defective, and excludes all other expressed or implied warranties. Non-Warranty damages under this Agreement are limited to repayment of the sales price of Seller upon satisfactory proof to Seller of defective nature of goods and return of the unused portion thereof.
